Law and jurisdiction

These terms and conditions apply to your use of Wedding Photo Swap, including our website, mobile apps and any services provided through them.

These terms, and the provision of goods and services by us, are governed by and interpreted in accordance with English law. In the event of any dispute arising in relation to these terms or the provision of any goods and services by us, the English courts will have exclusive jurisdiction over such dispute.

These terms and conditions do not affect your statutory rights.

You must be aged eighteen years or over to create an account, purchase an upgrade or agree to these terms. Guests under the age of eighteen may only use the service with permission from a parent, guardian or the account holder responsible for the wedding album.

We may modify these terms at any time. We will post the modified terms on the website. The modified terms will come into effect as soon as they are posted on the website, and use of the website, mobile apps or any services provided by Wedding Photo Swap after that point will be subject to the modified terms.

About Wedding Photo Swap

Wedding Photo Swap provides a service that allows couples to create private wedding photo albums and invite guests to upload, view, share, comment on and download photos and videos, depending on the features and settings available on the account.

The service is intended for personal wedding and wedding-related event use only. Use of the service to store non-wedding related content, unrelated personal photo libraries, commercial image libraries or content for a commercial purpose is prohibited unless we have given written permission.

We provide the service in good faith and expect users and guests to use it responsibly and lawfully.

Accounts, albums and guests

When you create an account, you are responsible for the information you provide, including your wedding details, album details and guest access settings.

You are responsible for keeping your login details secure and for making reasonable efforts to prevent unauthorised access to your account.

You are also responsible for any QR codes, guest links, passwords or invite links you share. Anyone with access to these details may be able to upload, view or interact with content, depending on the album settings available at the time.

Guests may be asked to provide basic details, such as their name and email address, before uploading or accessing an album. This helps us operate the service, associate uploads with the correct guest and provide a better experience.

Wedding Photo Swap is not responsible for who an account holder chooses to invite or for how QR codes, links or passwords are shared by the account holder or their guests.

QR codes and guest upload links

Wedding Photo Swap may provide QR codes, guest upload links or similar sharing tools to help guests access a wedding album quickly.

You are responsible for checking that your QR code, guest link and album settings work as expected before your wedding or event. We recommend testing the guest experience before printing QR code cards or sharing access details widely.

QR codes and guest links may direct guests to the website or app experience available at the time. Guests do not always need to download the app, but the available guest flow may vary depending on device, platform, browser and product updates.

We reserve the right to update, improve or change QR code and guest upload functionality at any time.

Free accounts and paid upgrades

As part of the service, we may offer free accounts and paid upgrades with different features, limits and storage allowances.

Free accounts allow customers to set up an account, create or test an album, invite guests and use a limited version of the service. The exact limits and features of free accounts are shown on our website, pricing page, app or upgrade screens and may change from time to time.

Paid upgrades may include additional storage, higher upload limits, high-resolution downloads, bulk downloads, longer access periods, video support, additional account features or other premium features shown at the time of purchase.

Features, limits, storage allowances and prices may vary depending on the plan selected, purchase platform, promotional offer, account type and the date of purchase.

We reserve the right to update our free and paid plans, features, limits and pricing at any time. Changes will not normally affect a paid upgrade already purchased for its current paid access period, unless required for technical, legal, security or operational reasons.

Storage periods, expiry and extensions

Paid upgrade storage periods are linked to the wedding date or event date shown on the account, unless stated otherwise at the time of purchase.

It is your responsibility to ensure that your wedding date or event date is entered correctly. If you believe your wedding date is displaying incorrectly, you should contact us as soon as possible so we can review it.

When a paid storage period ends, guest uploads, high-resolution downloads, bulk downloads, video access or other premium features may no longer be available unless you extend or renew your account.

We may contact you before or after your storage period ends, but we are not responsible if you do not receive or act on those reminders.

You should download and safely store any photos or videos you wish to keep before your storage period ends. Wedding Photo Swap should not be treated as your only permanent backup of important wedding photos or videos.

Uploading photos and videos

Photos and videos must be uploaded directly through the upload tools provided by Wedding Photo Swap, either through the website, mobile app or guest upload flow available at the time.

We do not guarantee support for importing photos or videos directly from third-party cloud storage services, social media platforms, messaging apps or external storage providers.

We may resize, compress, convert, process or optimise uploaded photos and videos in order to store, display, transmit, moderate, back up and make them available through the service.

You are responsible for ensuring that you have the right to upload any photo, video, comment or other content you add to Wedding Photo Swap.

Photo approval, moderation and removal

Depending on the features and settings available on your account, guest uploads may be visible immediately or may need to be approved by the account holder before they are visible to others.

The account holder is responsible for reviewing and managing guest uploads where approval or moderation tools are available.

We reserve the right to remove, hide, restrict or delete any content that we believe breaches these terms, infringes third-party rights, is unlawful, is inappropriate, may cause harm, may expose us to liability or may affect the operation or reputation of the service.

We are not responsible for the content that guests choose to upload, comment on or share through a wedding album.

Prohibited use of the website, app and service

You are not allowed to upload, post, comment on, email to us, share, store, request prints of or otherwise use the service in connection with any images, videos, comments or other material which contain or involve: pornographic or obscene material; racist material; material that is likely to incite hatred against any person or group; blasphemous material; defamatory or otherwise actionable material; images or recordings of any criminal act; material that infringes any copyright, trademark, privacy, publicity or other intellectual property or legal right of any third party; material that breaches any applicable laws or legislation; malicious files, viruses or harmful code; harassment, abuse, threats or intimidation; or any content that we reasonably consider unsuitable for the service.

You must not use Wedding Photo Swap to upload, store or distribute content for any unlawful, harmful, abusive, fraudulent or commercial purpose.

You must not attempt to interfere with the security, availability, performance or proper operation of the website, mobile apps, servers, databases or connected systems.

If we believe an account has been used in breach of these terms, we may issue a warning, restrict access, remove content, suspend the account, cancel the account or delete stored content at our discretion.

Photo and content ownership

Any images, videos, comments or other content uploaded to Wedding Photo Swap remain owned by you or the applicable copyright owner.

By uploading content to Wedding Photo Swap, you confirm that you either own the content or have the necessary permission from the copyright owner and any identifiable people shown in the content to upload it and make it available through the relevant wedding album.

You give Wedding Photo Swap a non-exclusive, worldwide, royalty-free licence to store, back up, host, process, resize, compress, convert, display, transmit, copy and make your uploaded content available as needed to operate and improve the service.

This licence allows us to show photos, videos, comments and related content within the associated wedding album, make them available to the account holder and invited guests, generate thumbnails, prepare downloads, support sharing features and provide any print or download features available through the service.

Wedding Photo Swap will not sell your images to unrelated third parties or use your private wedding photos in public marketing without your permission.

You may remove your own photos or content where the available account tools allow this. Account holders may also be able to remove guest uploads from their wedding album. Removed content may continue to exist temporarily in backups, logs or cached systems for technical, legal or security reasons before being permanently deleted.

Downloads, backups and customer responsibility

Wedding Photo Swap is designed to help collect, organise and share wedding photos and videos, but it should not be used as your only permanent backup.

You are responsible for downloading and safely storing copies of any photos or videos you wish to keep, especially before your paid storage period expires, before cancelling your account or before requesting deletion.

While we take reasonable care in operating the service, we cannot guarantee that uploaded content will always be available, uninterrupted, error-free or recoverable.

We are not responsible for loss of photos, videos or other content where this results from user error, account expiry, deleted content, incorrect account details, unauthorised access caused by shared login details, third-party platform issues, technical failures outside our reasonable control or failure to download content before the applicable storage period ends.

Service availability and feature changes

Wedding Photo Swap is provided on an ongoing basis and we may update, improve, add, remove, suspend or change features at any time.

Features may vary between the website, iOS app, Android app and guest upload experience. Some features may be released gradually, tested, changed or withdrawn.

We make reasonable efforts to keep the service available, but we do not guarantee uninterrupted access. The service may be unavailable from time to time due to maintenance, updates, faults, third-party provider issues, security incidents or circumstances outside our reasonable control.

We may suspend or restrict access to the service where necessary for security, maintenance, legal compliance, abuse prevention or operational reasons.

Payment, cancellations and refunds

Wedding Photo Swap offers free accounts and paid account upgrades. Paid upgrades may include additional storage, high-resolution downloads, bulk downloads, video support, extended account access and other premium features shown on our pricing page, app or upgrade screen at the time of purchase.

We recommend that customers use the free account first to check that Wedding Photo Swap is suitable before purchasing an upgrade.

For upgrades purchased directly through the Wedding Photo Swap website, you may cancel and request a refund within 14 days of purchase, provided you have not made significant use of the paid features.

Significant use may include, but is not limited to, uploading photos or videos above the free account limit, inviting guests to actively use the upgraded album, receiving guest uploads, downloading high-resolution photos, generating bulk downloads, using video features, using extended storage or otherwise receiving the main benefit of the paid upgrade.

Where you ask us to make the paid features available immediately, you acknowledge that we may begin providing the service straight away. If you cancel within the 14-day period after using paid features, we reserve the right to refuse a refund or provide a partial refund to reflect the service already provided.

After 14 days, upgrade fees are non-refundable unless required by law or unless the service is faulty and we are unable to resolve the issue within a reasonable time.

Refunds for website purchases are returned to the original payment method and may take several working days to appear, depending on your card provider or payment provider.

For upgrades purchased through the iOS app, payments and refund requests are handled by Apple. We cannot cancel, refund or reverse Apple payments from our side. You can request a refund from Apple through Apple’s refund process.

For upgrades purchased through Android or Google Play, payments and refund requests may be handled by Google Play, depending on how the purchase was made. Where Google controls the payment, refund requests must be made through Google Play.

Cancelling your account, deleting the app, deleting an album, not using the service or choosing not to invite guests does not automatically cancel, reverse or refund a paid upgrade.

Where an account is cancelled or refunded, access to paid features may be removed and any content above the free account limit may no longer be available. Customers should download any photos and videos they wish to keep before cancelling, requesting a refund or before their storage period ends.

Physical products and printed items

Where Wedding Photo Swap offers physical products, including personalised wedding stationery, QR code cards, prints or other printed items, these may be made to order.

Personalised or made-to-order items cannot usually be cancelled or refunded once production has started, unless they are faulty, damaged or not as described.

If an item arrives damaged, faulty or incorrect, please contact us as soon as possible with details and supporting photos where appropriate. Where we agree that an item is faulty, damaged or incorrect, we will arrange a replacement, refund or other appropriate remedy.

Account cancellation and deletion

You may stop using Wedding Photo Swap at any time. You may also contact us to request account deletion, subject to any legal, security, fraud prevention, accounting or operational records we are required or permitted to retain.

If your account is deleted, cancelled or closed, you may lose access to your albums, photos, videos, comments, guest uploads, downloads and paid features.

You should download and safely store any content you wish to keep before requesting account deletion or cancellation.

If an account is closed due to breach of these terms, we are not obliged to provide a refund.

Liability

You agree that use of Wedding Photo Swap is at your own risk. Wedding Photo Swap is provided on an "as is" and "as available" basis.

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights you have under consumer law that cannot legally be excluded.

Subject to the above, Wedding Photo Swap makes no guarantee that the service will be uninterrupted, error-free, secure, permanently available or suitable for your particular requirements.

Wedding Photo Swap reserves the right to change, withdraw, suspend or discontinue any functionality or feature.

Subject to your statutory rights, Wedding Photo Swap shall not be liable for any damages, losses, costs or expenses arising out of the use of or inability to use the Wedding Photo Swap website, mobile apps, albums, upload tools, QR codes, guest links, downloads or any content thereon.

This includes, without limitation, any damages or injury caused by failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication-line failure; third-party platform issue; payment provider issue; app store issue; cloud storage issue; network or system outage; unauthorised access; alteration or use of any record; or loss of uploaded content.

Wedding Photo Swap is intended for personal wedding use. We are not liable for business losses, loss of profit, loss of revenue, loss of goodwill, loss of opportunity or commercial losses.

Third-party services and platforms

Wedding Photo Swap may rely on third-party services and platforms to operate parts of the service, including payment providers, app stores, hosting providers, cloud storage providers, email providers, analytics providers and mobile operating systems.

We are not responsible for delays, failures, outages, payment decisions, refund decisions, device compatibility issues or service interruptions caused by third-party services or platforms outside our reasonable control.

Where you purchase through Apple, Google or another third-party platform, your purchase may also be subject to that platform’s own terms, payment rules and refund process.

General terms

You are responsible for keeping your login details secure and making reasonable efforts to prevent others from gaining access to your account.

No part of the Wedding Photo Swap website, mobile apps, branding, design, code, database structure, text, graphics or service may be reproduced, copied, recreated, scraped, resold or commercially exploited without our written permission.

If any part of these terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue in full force and effect.

If we do not enforce any part of these terms immediately, this does not mean we have waived our right to enforce it later.
